Your new Company

This company is a Canadian real estate investment trust. Eastern office is based out of Montreal, Qc (Ville St-Laurent) . It specializes in retail real estate, especially power centers. Almost all of its malls have Walmart as a tenant.

Your new Role

As the Lease administrator - you will be supporting leasing and development teams in drafting legal documents (including but not limited to): leases, lease renewals/lease amendments, other related documents, letters of intent, easements, letters of formal notice, financing and partnership agreements, declarations of co-ownership, etc. for the Eastern portfolio (Qc, Maritimes)

Reports To: Vice-President Development, Vice-President Leasing
Department: Legal Operations

The specific duties and responsibilities for this position include but are not limited to the following:

  • Draft leases and lease amendments in accordance with lease request forms submitted by leasing associates; OR incorporate terms of an executed offer to lease into Landlord’s precedent lease form and forward to Tenant for review;
  • Negotiate proposed amendments to the draft lease with the tenant and/or its solicitor, with input from leasing associates and in-house counsel;
  • Ongoing updating of Tenant precedent lease forms and updating Quebec approved and special clauses along with Quebec precedent documents;
  • Diarize important dates to ensure that deadlines are met with respect to non-disturbance agreements and estoppel certificates;
  • Track lease commencement and rent commencement dates as well as any other information required to complete lease summaries in a timely manner;
  • Review lease documents in detail and prepare lease summaries for use by accounting and other internal departments
  • Ongoing updating of tenant information on lease summaries;
  • Prepare and negotiate non-disturbance agreements between tenants and mortgagees;
  • Collect relevant information required to prepare and provide executed Estoppel Certificates to Landlord from tenants in a shopping centre for a permanent financing or sale transaction;
  • Prepare amending agreements, extension agreements, assignments of lease, release and surrender agreements, notices of default and lease termination letters (for existing tenants). Contact bailiff when needed;
  • Review notices of lease prepared by tenants, ensure the notice accurately reflects the terms of the Lease, and arrange for Landlord’s execution of same;
  • Liaise with Leasing, Development, Finance, Accounting and Construction departments as required;
  • Maintain and update databases with respect to the status of leases and mortgage information;
  • Field inquiries with respect to leases and lease summaries as they arise;
  • Attend monthly departmental meetings;
  • Answer special requests from lease administration team;
  • Prepare execution copies, site plans, and review prohibited uses of Tenant’s.

What you’ll need to Succeed*

  • Minimum of seven (7) to ten (10) years of experience in the administration of leases and the drafting of real estate documents;
  • Experience in drafting leases based on submitted rental offers or lease details as well as preparing/negotiating lease amendments and developing other ancillary documents;
  • Familiarity with lease terminology;
  • Excellent writing skills;
  • Professional title and certification in the paralegal field are assets.
  • Excellent oral and written communication skills, with the ability to communicate effectively with staff at all levels of a business, both internally and externally;
  • Mastery of MS Word and Excel software;
  • Ability to effectively manage multiple priorities;
  • Attention to detail, strong organizational skills and excellent time management skills.
